District school officials ignored and covered up a 4-year old student’s 2016 sexual assault, failing to notify parents of the incident. The lawsuit, filed on Oct. 2, contends that on Dec. 14, 2016, a 4-year old girl was sexually assaulted by a 4-year old boy in a unisex bathroom.
The girl left the class unattended that day to go to the bathroom. A boy in the same classroom, who identified as the suspect is also being withheld followed her to the bathroom, also unattended by an adult or teacher.
When the girl returned to her classroom, the pants she was wearing were inside out and her shoes were on the wrong feet. Her parents immediately noticed her altered appearance when picking her up from school and later learned that she had been sexually assaulted when she had gone to the bathroom unattended.
The lawsuit alleges that the defendants committed numerous Title IX violations and violated the girl’s constitutional rights under the color of the law. The girl’s family is seeking $10 million in damages, a jury trial, and all attorney fees paid.
The lawsuit states that the girl’s parents questioned the school’s administration about the assault and that, “such questions were met by false statements and denials of wrongdoing.”
