Domestic violence offenses usually involve spouses, partners or people who are dating or living together. The prosecutors and lawmakers will continue to pursue the case even in situations where the alleged victim wishes to drop all charges. Therefore, it is crucial to have an experienced defense on your side.
A minor domestic incident could quickly lead to a more serious domestic abuse charge. For instance, if a harassment charge is alleged by a victim, and it’s found the victim and offender were involved in an intimate relationship, the law enforcement is required to make an immediate arrest to ensure the continued safety of the alleged victim, as well as the safety of other occupants in their home.
An athlete was placed on administrative leave following fresh allegations of domestic violence from his ex-wife.
Last year, his ex-wife posted a photo on her Instagram account with a caption suggesting her husband of about 18 months had been unfaithful to her. In another post, a user — described by her as a close friend — made the accusation that the player had “hit” his wife. The post was later deleted. The player denied the allegation and the two divorced.
In another blog post attributed to the athlete contained more detailed allegations, including years of physical and emotional abuse. Less than 12 hours later, Major League Baseball announced the athlete had been put on leave under the 2015 domestic violence agreement between management and the players’ union.

In Houston, a federal judge has affirmed a jury’s guilty verdict for a Brazilian couple tried on allegations that they helped their daughter in the international kidnapping of their 8-year-old grandson, in a case that garnered widespread attention from top officials in two countries.
Following the guilty verdict, defense lawyers had asked the judge to reconsider the verdict.
On May 25, the jury found the parents guilty of helping in international parental kidnapping. The jury acquitted them both of conspiracy to kidnap the child.
The judge ruled that a reasonable juror could have concluded beyond a reasonable doubt the husband and wife helped kidnap their grandson.
A reasonable juror, he said, could also have concluded based on the majority of the evidence that their daughter, was not fleeing a pattern or incident of domestic violence when she left Houston with the boy in 2013 and settled in Brazil. This so-called “affirmative defense” — that they had reason to believe she was in danger — could have effectively canceled out the kidnapping charges against them, which is what defense lawyers had asked the judge to do.

In Harris County, prosecutors launch an outreach program to reduce high levels of domestic violence. If immigrants who are victims of domestic abuse are too afraid to contact authorities for fear they will be deported, Harris County prosecutors say they’ll come to them.
The outreach initiative comes as the rate of domestic violence continues to rise in Texas, where more than 550 women were killed by their partners between 2012 and 2016.
Harris County has the highest number of domestic violence deaths in the state, and about 7,000 charges are filed every year on average.

This is what the two athletes should have done if they wish to get out of the case they are in.
In one incident, a Major League Baseball and the players union reached a joint policy on domestic violence, sexual assault and child abuse in 2015. Since the league’s policy was enacted, seven players have received suspensions, including one of Astros’ newest reliever, who is serving a 75-game suspension after a domestic violence incident in May.
In another incident, another athlete has accepted a 40-game suspension for violating Major League Baseball’s domestic violence policy.
The player’s unpaid suspension includes the 11 regular-season games he missed after being placed on administrative leave. He will also participate in an evaluation and treatment program.

In Houston, domestic violence charges against noted a famous rapper were dismissed after the 41-year-old completed a batterer intervention program.
The well-known performer was accused of brandishing a gun while beating his rapper ex-girlfriend.
According to the rapper’s ex-girlfriend, the couple was at their home in the Katy area in April 2017 when he slapped her, punched and dragged her for an hour and a half. She said she was assaulted so many times “she eventually got sick and threw up.”
She reported the allegations three months after the incident and gave police a 20-minute audio recording of the alleged assault to back up her claim.
Investigators said they could hear the rapper state “you’re dead” in the recording as well as sounds that appeared to be slapping, court records show. Police also heard the girlfriend state “why did you just push me” and “get your fu**ing hands from around my neck.”
In a typical pre-trial diversion agreement, prosecutors dismissed the case because the rapper completed a class on preventing domestic violence. In court documents filed, prosecutors said there was probable cause to arrest the rapper, but that the case would be dropped.
If convicted of aggravated assault of a family member, the rapper could have received up to 20 years in prison.

In Galveston, a 60-year old man was found guilty of misdemeanor assault by a jury. He was originally charged by indictment with Aggravated Assault with a Deadly Weapon, but the jury found him guilty of the lesser included offense of assault.
The Court assessed the maximum punishment for the offense – one year in the county jail. He had been in the county jail since the date of offense, May 5, 2015. The Court also made a finding that the offense involved domestic violence.
Witness testimony and physical evidence suggest that the man went to the workplace of his recently estranged wife in La Marque, assaulted her with a knife and strangled her during an ensuing struggle. Jurors heard testimony from the victim’s co-worker, who had left the victim alone inside the business just prior to the assault.
The co-worker testified that she returned to the workplace to find police officers in front of the store, the store showing signs of a disturbance, and the victim in a highly emotional state. Police recovered the knife from the scene, and it was entered into evidence at trial.
Prosecutors also presented photographs showing red marks to the victim’s neck. Jurors heard the 911 call made by the victim as she fled from the attack, running to an office next door. During the call, the victim frantically reported that her husband had attacked her with a knife and had choked her. The victim did not testify at trial.
Jurors also heard a call from the victim to law enforcement, made the day before the attack, wherein she sought an escort back to the house where the man was still residing. She told the dispatcher that Bernstein had been making threats against her and she did not know what he would do.
The man took the stand at trial, testifying that he woke up at 6 a.m. on May 5, 2015, and thought as to the victim, “that was the last day I would know where she was.” (The victim had left their shared home several days prior and was also leaving her job.) He admitted that he went to the victim’s workplace, waited outside until she was alone inside the store (this was captured on surveillance video from a nearby business), and then approached the victim behind the register.
The man claimed that the victim was the one to pull out the knife, but that he continued toward her in order to make her talk to him. He testified the victim grabbed for a phone with her other hand, but he fought her for the phone. He stated he did not want the victim to call for help. Bernstein further testified that eventually, the victim was able to get out from behind the counter and run toward the door, but he tackled her to keep her from leaving and getting help.
