All-Star Player Accepted A 15-Game Suspension For Domestic Violence

A minor domestic violence incident could quickly lead to a more serious domestic abuse charge. For instance, if a harassment charge is alleged by a victim, and it’s found the victim and offender were involved in an intimate relationship, the law enforcement is required to make an immediate arrest to ensure the continued safety of the alleged victim, as well as the safety of other occupants in their home.

An All-Star reliever accepted a 15-game suspension under Major League Baseball’s domestic violence policy, discipline stemming from an altercation last October.

The suspension was the fourth and least severe under the policy, which was agreed to in August 2015. The reliever was penalized 29 games.

He was arrested Oct. 31 on a simple assault charge, but prosecutors later dropped the case. Under the domestic violence policy, a player can be disciplined absent a criminal conviction

The player is eligible to continue to participate in all spring training activities and exhibition games and leading up to the game’s opener and then must sit out the team’s first 15 games. He can participate in up to six minor league games while serving the penalty.

Barring any postponements, he would be eligible to return April 20 at home against another state and would lose $730,328, which is 18-183rds of his $7,425,000 salary. Under a change this year to baseball’s joint drug agreement, he loses the salary of off-days during the suspension, in addition to the pay on the days of games he misses.

The player has undergone 12 90-minute counseling sessions, and that the counselor said he was willing to take steps to ensure he will not be involved in another incident. He also will speak to other players about his learning process and will donate time and money to domestic violence prevention organizations.

He was charged after his wife made several frantic 911 calls to police in Fort Lee, New Jersey, in which she described her husband as drunk. According to his wife, he had a little bit of alcohol, and he’s going crazy. She was left with scratches on her chest and a bruise on her right cheek.

A judge dismissed charges in December after the player’s wife told a prosecutor her husband did not hurt her.

Domestic violence offenses usually involve spouses, partners or people who are dating or living together. The prosecutors and lawmakers will continue to pursue the case even in situations where the alleged victim wishes to drop all charges. Therefore, it is crucial to have an experienced defense on your side.

Man Out On Bond For A Domestic Violence Case Now Accused of Murder

A man was released from jail after posting a $10,000 bond on Jan. 3, for a domestic violence arrest. Three days later, he allegedly shot a 29-year-old man to death.

He is believed to have wrestled a gun away from the man as he guarded the salon in the Imperial Valley Drive during a concert. He was also collecting a cover for the after-hours concert happening inside.

Police authorities opened fire with his weapon and shot him once, according to investigators. He fled the salon with the gun and cash, police said. He soon died at the salon.

Last week, authorities shared surveillance footage of the suspected gunman. He was arrested in the death and has been charged with murder.

He was previously jailed Dec. 29 after allegedly beating his girlfriend. Prosecutors asked that he be held without bond because of his lengthy criminal history and to protect the woman he was dating, according to court papers. He was slated to be arraigned in that case in February. Past convictions include criminal mischief, evading motor vehicle, theft, trespassing, and robbery.

A mental health evaluation was ordered for the man shortly before he appeared in court.

Church Shooting Fallout, Only 1 Domestic Violence Conviction In 2016

The U.S. Department of Defense — now under scrutiny for failing to report a domestic violence conviction that could have stopped a man from purchasing several guns used in the Texas church shooting — reported just one domestic violence conviction to a national FBI database in all of 2016.

An FBI report of active records on the National NICS’ records from December 2016 shows the Department of Defense had just one domestic violence conviction case on file. The report also shows that the DOD had not submitted any records for members barred from buying guns from dealers because of domestic violence restraining orders.

The man slaughtered 26 worshipers in Sutherland Springs southeast of San Antonio Sunday in the midst of what investigators said was a “domestic dispute” with his mother-in-law.

Twenty other people were injured and about half remain hospitalized. He was shot twice by a church neighbor as he tried to leave the scene. The neighbor jumped in a car with another man and they chased him until he crashed. He was found dead in the vehicle of a self-inflicted gunshot wound.

Investigators confirmed that he passed a federal background check and was allowed to buy four firearms before his shooting spree.

His prior military conviction for assaulting his wife and stepson should have precluded him from gaining clearance for the purchases, however. He joined the U.S. Air Force in 2009, and in 2012 Kelley was court-martialed and pleaded guilty to assaulting his wife and stepson, earning a demotion and sentence of one year of confinement.

As of Oct. 31, there were 11,189 Dishonorable Discharge entries made by the Department of Defense. As of Nov. 6, there are 2,248 dishonorable discharge entries and one mental health entry from the Air Force within the NICS Indices. The Department of Defense also had one entry for a felony conviction and one for mental health.

The NCIC is one of three databases – including the Interstate Identification Index and National Criminal Instant Background Check System indices – used in background checks on gun purchasers before they can legally obtain firearms.

Even if the records were properly entered into one of the three databases used to perform background checks, however, it’s not guaranteed that the man would have been stopped before purchasing a weapon.

The GAO reviewed 59,000 cases involving domestic violence convictions and 30,000 involving protective orders and found more than 6,700 instances where purchasers still walked away with firearms.

A minor domestic incident could quickly lead to a more serious domestic abuse charge. For instance, if a harassment charge is alleged by a victim, and it’s found the victim and offender were involved in an intimate relationship, the law enforcement is required to make an immediate arrest to ensure the continued safety of the alleged victim, as well as the safety of other occupants in their home.

Actor Arrested For Domestic Violence After Dispute With Wife

Domestic violence offenses usually involve spouses, partners or people who are dating or living together. An actor was arrested in the front yard of his for domestic violence after a dispute with his wife. According to authorities, the 45-year-old was booked on one count of domestic violence simple assault, which is considered a misdemeanor.

A spokesperson told authorities that the arrest was an isolated incident that “stemmed from a private marital matter” and that the couple is addressing the matter privately.

According to the reports, the actor was previously arrested and charged with domestic violence in 2012 after allegedly pulling his first wife’s hair and hitting her on the head.

The charges were later dismissed after London took a plea deal that required he show proof of completing 20 anger management classes.

The couple has been married since 2014.

Domestic Violence Claimed 146 In Texas In 2016; 28 In Harris County

An organization compiles an annual report called “Honoring Texas Victims,” which tracks the toll domestic violence inflicts on victims across Texas.

Last year, 28 women died in Harris County at the hands of their domestic partners.

One of the victims died after her husband shot her in the backyard of the couple’s home, along with her 74-year-old daughter before turning the gun on himself.

Domestic abusers killed women in 54 other counties around the state, according to the report.

Harris County – as is often the case because of its large population – recorded the most deaths, followed by Tarrant and Dallas counties, which each had 13 victims. Bexar County was the site of 11 fatalities. In addition to the 146 women killed last year, domestic abusers also killed another 24 family members and friends, according to the report.

The total number of fatalities — the second-highest tally since 2011 and down slightly from last year’s 158 deaths – underscored the pervasiveness of domestic violence, according to the person who supervises the Houston Police Department’s Special Victims Division.

In two-thirds of the deaths, perpetrators used a firearm to kill their partners, according to the report. Seventy-seven percent of the slayings occurred in a home.

Domestic violence offenses usually involve spouses, partners or people who are dating or living together. The prosecutors and lawmakers will continue to pursue the case even in situations where the alleged victim wishes to drop all charges.
