Domestic Violence Case Dropped Against Popular Houston Rapper

A minor domestic incident could quickly lead to a more serious domestic abuse charge. For instance, if a harassment charge is alleged by a victim, and it’s found the victim and offender were involved in an intimate relationship, the law enforcement is required to make an immediate arrest to ensure the continued safety of the alleged victim, as well as the safety of other occupants in their home.

In Houston, domestic violence charges against noted a famous rapper were dismissed after the 41-year-old completed a batterer intervention program.

The well-known performer was accused of brandishing a gun while beating his rapper ex-girlfriend.

According to the rapper’s ex-girlfriend, the couple was at their home in the Katy area in April 2017 when he slapped her, punched and dragged her for an hour and a half. She said she was assaulted so many times “she eventually got sick and threw up.”

She reported the allegations three months after the incident and gave police a 20-minute audio recording of the alleged assault to back up her claim.

Investigators said they could hear the rapper state “you’re dead” in the recording as well as sounds that appeared to be slapping, court records show. Police also heard the girlfriend state “why did you just push me” and “get your fu**ing hands from around my neck.”

In a typical pre-trial diversion agreement, prosecutors dismissed the case because the rapper completed a class on preventing domestic violence. In court documents filed, prosecutors said there was probable cause to arrest the rapper, but that the case would be dropped.

If convicted of aggravated assault of a family member, the rapper could have received up to 20 years in prison.

TX Leaders Join Fray as Killing Reignites Illegal Immigration Hold Clash

The death of a 20-year-old college student allegedly at the hands of an immigrant in Iowa has upended the immigration hold debate and galvanized Republicans ahead of the midterm elections.

A new report based on Texas crime statistics shows that people in the country illegally commit serious crimes at lower rates than native-born Americans.

The rate for legal immigrants is even lower.

Nevertheless, the arrest of a man suspected of being in the country illegally in the death of Iowan woman has fueled the hardline position that illegal immigration hold is a significant source of crime, turning it into a potent GOP campaign theme.

In a TV interview, Trump called the woman “this beautiful young girl … killed by a horrible person that came in from Mexico, illegally here,” suggesting the need for his proposed border wall and tougher immigration laws.

Trump also has strongly backed the Houston-based Remembrance Project, which opened a Washington office in the early days of his administration to champion the victims of crimes committed by immigrants living in the country illegally.

“It’s another example of an American being killed by someone who should not be here in the first place, and that’s directly due to our current laws not being enforced, our borders not being secured, and elected officials not protecting America and its citizens,” said Remembrance Project co-founder Maria Espinoza.

Soon after the woman’s body was found in a cornfield, a month after she disappeared while jogging, a Texas governor tweeted, “This is why so many Americans are angry about sanctuary cities. It’s why Texas banned sanctuary cities. It’s about safety.”

Texas Leaders to Place Immigration Hold To Who Are Accused of Crimes

Amid a brewing political debate over the shooting death of a San Francisco woman by a man who had been deported five times, a Texas lawmaker attached a measure to a homeland security bill that would make it harder to release illegal immigrants with long criminal records. This immigration hold won’t allow those illegal immigrants.

The Houston Republican said his measure would bar the release of a broader range of convicted criminals, including those with records of domestic violence or sexual assault.

The move comes amid heightened GOP criticism of President Barack Obama’s immigration policies in the wake of the July 1 shooting of an alleged illegal immigrant with a long criminal record.

The measure touches on larger opposition by Republicans to immigration reform efforts by the current administration.

However, another U.S. representative opposed the measure, saying it could lead to the indefinite detention of illegal immigrants who have not committed dangerous crimes.

The accused, now in custody, had been deported five times. He was turned over to San Francisco police by the U.S. Immigration and Customs Enforcement agents to face drug charges. Though federal agents requested that they are informed if he was released, the city apparently did not honor that request.

A 31-Year-Old Houston Father of Two Is on Immigration Hold

Immigration agents deported a 31-year-old Houston father of two American children who have been here since he was 15 and had a temporary reprieve from deportation and no other criminal record.

The 22-year old went to the Houston immigration office for his annual check-in. He had a provisional stay of deportation and a work permit since 2012, when he was released from immigration custody after a media and congressional campaign drew attention to his case.

His arrest is part of a wave of detentions across the country after the Trump administration released new guidelines last month making practically every immigrant here illegally, even those like Escobar who have provisional protection from deportation, eligible for removal.

As a defense to his case, they didn’t give the man a chance to do anything. His lawyer was notified that he had been deported back to El Salvador, a country he hasn’t seen in 16 years.

Unlike the violent criminals Trump has said he would focus on, the accused man landed in deportation proceedings because of a simple paperwork gaffe.

His mother sent for him when he was 15 and like her, he qualified for temporary protected status for people fleeing widespread disasters in certain countries.

She assumed his permit would automatically renew when she reapplied for hers. But it didn’t.

Because they had moved, they didn’t receive the paperwork informing him that he had missed the deadline.

When he finally figured out what had happened, he tried to reapply for the permit but it was too late. The government had already initiated deportation proceedings. His wife said their lawyer told him not to show up at the court hearing or he would be deported. In his absence, the judge ordered him removed in 2006.

But with no one trying hard to find him, his family lived a normal life, moving to New Orleans and then back to Houston. Their son Walter was born.

On June 6, 2011, immigration agents arrested him as he pulled out of his driveway to go to work. His wife consulted with lawyers, created a petition on Change.org, and recruited the help of a US representative.

Her efforts paid off. After seven months in detention, immigration agents released the man in January 2012 on an order of supervision, a provisional stay of deportation in a process known broadly as prosecutorial discretion. He was required to check in with immigration agents once a year and given a temporary work permit.

It was part of a wave of reprieves announced that year by the administration of former, who said he wanted to focus the government’s limited resources on deporting violent criminals, rather than people with clean records who have been here for years and have American children.

But now such priorities have been rescinded. It’s swept fear across the country that’s been heightened by widespread raids and incidents like the arrest of a 22-year-old in Mississippi.

A Man Accused of Sexual Assault was Placed Under Immigration Hold

In criminal cases involving non-citizens, authorities often place an immigration hold or immigration detainer on the person so that they can take them into custody or start an investigation when they are released.

If a non-citizen is arrested and has an immigration hold, it is important to contact an attorney with experience in both criminal law and immigration law. Once in immigration custody, the non-citizen will often be moved to a distant immigration holding facility. If the non-citizen is moved to immigration custody prior to resolution of their criminal case, the immigration authorities may or may not return the non-citizen to criminal court for a scheduled criminal court appearance.

In Galveston, a 56-year old who was charged with sexual assault was also placed under immigration hold after allegedly harassing a 14-year old girl.

He is accused of luring a girl under the age of 14 into his apartment, locking the door behind her and proceeding to sexually assault her.

The victim’s father told police he saw his daughter walking out of another apartment unit in Galveston.

As a defense to the case filed against him, the man told police the girl knocked on his door asking for water. He said she told him to engage in a sexual act with her. He told police she then jumped on him, but he did not know if he penetrated her.

According to public records, he is on an immigration hold at Galveston County jail. His bond is set at $80,000 for the felony charge.
