Amid Church Shooting Fallout, 1 Domestic Violence Conviction in 2016

The U.S. Department of Defense — now under scrutiny for failing to report a domestic violence conviction that could have stopped a man from purchasing several guns used in the Texas church shooting — reported just one domestic violence conviction to a national FBI database in all of 2016.

An FBI report of active records on the National NICS’ records from December 2016 shows the Department of Defense had just one domestic violence conviction case on file. The report also shows that the DOD had not submitted any records for members barred from buying guns from dealers because of a domestic violence restraining order.

The man slaughtered 26 worshipers in Sutherland Springs southeast of San Antonio Sunday in the midst of what investigators said was a “domestic dispute” with his mother-in-law.

Twenty other people were injured and about half remain hospitalized. He was shot twice by a church neighbor as he tried to leave the scene. The neighbor jumped in a car with another man and they chased him until he crashed. He was found dead in the vehicle of a self-inflicted gunshot wound.

Investigators confirmed that he passed a federal background check and was allowed to buy four firearms before his shooting spree.

His prior military conviction for assaulting his wife and stepson should have precluded him from gaining clearance for the purchases, however. He joined the U.S. Air Force in 2009, and in 2012 Kelley was court-martialed and pleaded guilty to assaulting his wife and stepson, earning a demotion and sentence of one year of confinement.

As of Oct. 31, there were 11,189 Dishonorable Discharge entries made by the Department of Defense. As of Nov. 6, there are 2,248 dishonorable discharge entries and one mental health entry from the Air Force within the NICS Indices. The Department of Defense also had one entry for a felony conviction and one for mental health.

The NCIC is one of three databases – including the Interstate Identification Index and National Criminal Instant Background Check System indices – used in background checks on gun purchasers before they can legally obtain firearms.

Even if the records were properly entered into one of the three databases used to perform background checks, however, it’s not guaranteed that the man would have been stopped before purchasing a weapon.

The GAO reviewed 59,000 cases involving domestic violence convictions and 30,000 involving protective orders and found more than 6,700 instances where purchasers still walked away with firearms.

Domestic Violence Claimed 146 Lives in Texas in 2016; 28 in Harris

An organization compiles an annual report called “Honoring Texas Victims,” which tracks the toll domestic violence inflicts on victims across Texas.

Last year, 28 women died in Harris County at the hands of their domestic partners.

One of the victims died after her husband shot her in the backyard of the couple’s home, along with her 74-year-old daughter before turning the gun on himself.

Domestic abusers killed women in 54 other counties around the state, according to the report.

Harris County – as is often the case because of its large population – recorded the most deaths, followed by Tarrant and Dallas counties, which each had 13 victims. Bexar County was the site of 11 fatalities. In addition to the 146 women killed last year, domestic abusers also killed another 24 family members and friends, according to the report.

The total number of fatalities — the second-highest tally since 2011 and down slightly from last year’s 158 deaths – underscored the pervasiveness of domestic violence, according to the person who supervises the Houston Police Department’s Special Victims Division.

In two-thirds of the deaths, perpetrators used a firearm to kill their partners, according to the report. Seventy-seven percent of the slayings occurred in a home.

Sheriff Offers “Safe Surrender” Of Firearms In Domestic Violence Cases

In Harris County, we know that more than 40 percent of our homicides are the result of domestic violence. That’s why they announced a new initiative that would temporarily store firearms turned in by people who have protective orders filed against them in domestic violence cases.

The establishment of the “Safe Surrender” program is considered a major gain for domestic violence victims and advocacy groups since more than half of 2017 domestic violence fatalities in Texas are caused by gunshots.

In Harris County last year, there were almost 60,000 calls made to domestic violence hotlines. The county also led Texas that year in the highest number of deaths as a result of domestic violence, with 29 fatalities. Statewide, 136 women were killed, 65 percent of whom were shot. And the moment a victim decides to leave her abusive partner, her chances of being severely injured or murdered increases by 75 percent, studies show.

State and federal laws, enacted in the 1970s, mandates that people with protective orders filed against them are not allowed to possess firearms.

However, the judge said those individuals’ options were limited to either selling or transferring their guns to other people, resulting in many of them keeping their weapons unlawfully.

A year and a half ago, domestic violence agencies in Harris County joined with law enforcement agencies to establish the Safe Surrender Committee, which met monthly to find a way to decrease firearm possession among abusers.

As part of the new initiative, when a court approves a protective order against an individual, a copy will be sent to a Harris County Sheriff’s Deputy assigned to the Safe Surrender program. The individual then has the option to reach out to the deputy to store the firearm with the department until the protective order is expired.
