An apparently intoxicated man who was on DWI probation was charged with murder after he got into a fatal crash the previous day with two children in his vehicle.
The man was driving a Chevy Tahoe with two child passengers about 11 p.m. in the 9500 blocks of West Little York, just northwest of Houston’s city limits in the Jersey Village area.
Crash investigators with the Harris County Sheriff’s Office say the man crossed the center dividing line and struck the front of a GMC truck. The other driver was badly injured. He died shortly after the crash. The sheriff’s office says deputies arrested the man because he showed signs of intoxication.
He was charged with first-degree murder, according to court documents. He may be charged under the statute known as “felony murder,” which does not require intent to kill.
“If in the course of committing a felony, if a person commits an act that is dangerous to human life and it causes a death, then they can be charged with murder,” Sandra Guerra Thompson, director of the University of Houston Law Center’s Criminal Justice Institute, told the Chronicle last year.

Driving in the wrong way could lead to a DWI arrest. The story of a Houston man will tell you how it happened.
The Houston man was seen driving the wrong way along a stretch of the Grand Parkway in Spring. A Montgomery County deputy constable spotted the man along the Grand Parkway near Rayford Road. The dash cam video shows the man passing the deputy constable, who immediately turned around and signaled his lights.
Authorities said the deputy constable immediately detected a strong odor of alcohol when he walked up to the driver’s car.
The driver was taken into custody for driving while intoxicated after failing both a field sobriety test and a portable breath test. A sample of his blood remains to be tested to determine the alcohol content.
The “No Refusal” Policy
A “No Refusal” program reinforced in last March to lower the number of drivers who still get behind the wheel after consuming excessive amounts of alcohol, a banned substance, or drugs. The “No Refusal” policy gives the police officers to draw blood samples from any driver suspected of alcohol consumption without the need to produce a search warrant if they refuse to comply to take a breath test or decline to give a blood sample voluntarily.

A Houston man faces a drunk driving charge after allegedly hitting and killing a pedestrian in northwest Houston. The 44-year old Houston man was charged with driving while intoxicated, according to court records. He is being held in the Houston city jail in lieu of a $500 bail.
The man is accused of hitting and killing a pedestrian at about 7:20 p.m., as he drove north in the 900 blocks of West TC Jester. The pedestrian – who has not been identified – was trying to cross the street, but was not in a crosswalk. The pedestrian died at the scene. The driver was immediately taken into custody. On June 28, 2017, a Montgomery County jury found the man guilty of Driving While Intoxicated in connection with a Sept. 26, 2016, incident in Porter. According to prosecutors, the man nearly struck a woman who was driving along US 59 near FM 1314. The woman called the police and described his vehicle, including the license plate. She said the man was driving recklessly through a Kroger parking lot.
Troopers with the Texas Department of Public Safety found the man inside the store buying liquor. He failed a field sobriety test. A blood sample later detected alcohol, marijuana, Xanax, Hydrocodone and a muscle relaxant in his system, officials said.
In his most recent DWI conviction, the man was sentenced to 15 years in prison in connection with a January 2001 arrest. He finished his parole in that case shortly before committing the incident in Porter, according to the officials.
