You Should Seek Legal Help If Facing Sexual Assault Cases

Officials arrested and charged 11 people with sex-crime felonies throughout the month of Dec. 2018. The charges include aggravated sexual assault of a child, sexual assault, indecency with a child, incest with an adult, aggravated sexual assault of a disabled person and attempted sexual assault of a child. Of the 11 felony charges, more than half were tied to a child or minor.

In one incident, a suspect is wanted for forcing two teenagers into a wooded area at gunpoint, making them have sexual relations and then sexually assaulting one of the pair, a 15-year-old girl.

The incident happened on June 30, a 15-year-old female and a 16-year-old male were sitting in a parked car having a meal together at around 2 a.m. at Northline Park when a man approached the vehicle.

The man, whom the teenagers described as a white male with blond hair and a medium build, forced his way into the vehicle and brandished a firearm, the teenagers told police. The armed man then commanded them to get into the backseat of their car, took the wheel and drove them to a second location roughly 7 miles away from the park.

At the new location, the suspect forced the juveniles out of the car and into a wooded area. The teenagers said the man then forced them, at gunpoint, to have sexual relations with each other as he watched. They complied with his demands, they told police.

According to the report, the suspect then sexually assaulted the female multiple times. The two teens were able to get the weapon away from the suspect, who fled the scene on foot. The victims reported the attack shortly afterward.

The female teen was transported to an area hospital for treatment.

Trump’s New Guidelines on Sexual Assault Accusations

A new guideline regarding sexual assault rules was issued asking school officials for a higher standard of evidence when weighing sexual assault accusations. The new rules replaced Obama-era guidelines that suggested schools quickly take action in cases where evidence of sexual violence was more likely than not.

As students return or enter college for the first time, and as the new rules are battled in federal court, the way colleges handle upcoming cases of sexual violence is paramount— especially during the start of the semester.

More than 50 percent of college sexual assaults occur in either August, September, October, or November,” according to the Rape, Abuse & Incest National Network (RAINN).

In addition, recent studies on the prevalence of sexual assault on campus also show the need to quickly straighten out any federal guidelines that aim to protect victims.

In 2015, a survey by the Association of American Universities reaching 150,000 college students found that 23 percent of undergraduate women reported being victims of non-consensual sexual contact compared to 5 percent of undergraduate men.

The same researchers noted that these incidents don’t always get reported to school officials, possibly because students feel uncomfortable coming forward if colleges don’t have adequate resources and training to support survivors.

Hire Criminal Defense Attorney If Facing Assault Case

The story below is just one of the many cases involving an assault. These types of criminal cases, if not properly defended by an assault lawyer, could lead to a more serious consequence rather than just bail or fine.

District school officials ignored and covered up a 4-year old student’s 2016 sexual assault, failing to notify parents of the incident. The lawsuit, filed on Oct. 2, contends that on Dec. 14, 2016, a 4-year old girl was sexually assaulted by a 4-year old boy in a unisex bathroom.

The girl left the class unattended that day to go to the bathroom. A boy in the same classroom, who identified as the suspect is also being withheld followed her to the bathroom, also unattended by an adult or teacher.

When the girl returned to her classroom, the pants she was wearing were inside out and her shoes were on the wrong feet. Her parents immediately noticed her altered appearance when picking her up from school and later learned that she had been sexually assaulted when she had gone to the bathroom unattended.

The lawsuit alleges that the defendants committed numerous Title IX violations and violated the girl’s constitutional rights under the color of the law. The girl’s family is seeking $10 million in damages, a jury trial, and all attorney fees paid.

The lawsuit states that the girl’s parents questioned the school’s administration about the assault and that, “such questions were met by false statements and denials of wrongdoing.”

Assault conviction may lead to:

  • Loss of custody of your children.
  • Loss of your job
  • Loss of housing or your lease.
  • Penalties ranging from a fine of up to $500 – $10,000 and up to 2 – 20 years in prison, depending on whether the charge is classified as a misdemeanor or felony.

If you are an immigrant or a temporary citizen of the United States,

  • You could be deported back to your home country.
  • Loss of the right to own or possess a firearm.

Video Found of a Man on Sexual Assault to a Young Girl on His iPhone

Sexual assault is one of the most common criminal charges in Texas.  If not defended properly by an assault lawyer, it could lead to a more serious consequence.

In La Porte, family members of a man found a video of him sexually assaulting a young girl while borrowing his iPhone earlier this month. According to an arrest warrant affidavit, the 67-year old man lent his iPhone to his sister, who then gave it to her granddaughters to play with on Nov. 28.

Moments later, the granddaughters brought the phone to the man’s sister and said there was something on the phone she should see.

When she looked, she found a video from June 2017 of the man allegedly sexually assaulting an unknown girl.

Investigators investigated the video and arrested the man days later.

He’s now in jail with a $50,000 bail amount on charges of first-degree felony aggravated sexual assault of a child and third-degree felony possession of child pornography.

He could face up to life in prison if convicted.

This isn’t the man’s first arrest on child sex charges. In 1994, he was charged with indecency with a child – but a grand jury later found no reason to believe he should be charged. He was arrested for the same charge again in 2002, but that charge was dismissed.

He successfully completed a deferred adjudication program on a public lewdness charge in 2004.
