An Officer From The Texas City Police Department Was Charged With DWI

Police officers in Texas are responsible for ensuring the safety of all the citizens in the country. They are expected to act in accordance with the law and regulations promulgated by the state. When there is a failure to comply with these statutes, they can be subjected to a criminal, civil or administrative case. The charge depends on the attending circumstance of each case.

A special law in Texas prohibits a police officer to drive while under the influence of alcohol. This is violated by one police cop a day after New Year. On January 2, Officer Adam Hernandez was involved in a head-on collision. When the accident happened, the police officer was off-duty and was driving in his Ford pickup.

According to a witness, the vehicle driven by Officer Hernandez crashed because the latter fell asleep while he was traversing the road. Based on the investigation report submitted, it showed that the colleagues of the police officer from the Texas City Police Department responded to a minor accident at the State Highway. When they arrived at the area, they noticed that the police officer was intoxicated.

A case for DWI or driving while intoxicated was filed against Officer Hernandez. He denied such allegation and argued that he was merely using his cellphone, which led to the accident. He claimed that he played a game on his smartphone. In his affidavit, he admitted that the crash was his fault due to the fact that he was not paying attention while driving. However, he denies that his intoxication resulted in a crash.

When asked for a sobriety test, he refused to provide a breath specimen. However, the court issued a warrant to compel him to provide for a blood specimen. Up to this date, there was still no official statement from the Texas City Police Department on its possible disciplinary action against the erring police officer.
